Terms of Service

1. Agreement to Terms

By placing a reservation with Fun Zone Party Rentals ("Company," "we," "us," or "our"), you ("Customer") agree to be bound by these Terms of Service. All rentals are for use by adults or under adult supervision; customers must be 18 years of age or older to enter into this agreement. These Terms constitute a legally binding contract under the laws of the State of Florida.

2. Reservations & Deposits

All bookings require a 25% deposit at the time of reservation to secure your date and equipment. The remaining balance is due no later than 24 hours prior to the scheduled delivery/drop-off time. Failure to pay the remaining balance by the due date may result in cancellation of your reservation without refund of the deposit.

Reservations are not confirmed until the deposit has been received and you have received a written confirmation from Fun Zone Party Rentals.

3. Cancellation & Refund Policy

• More than 7 days before the event: Full refund of all amounts paid, including the deposit.
• 7 days or fewer before the event: No cash refund. A credit equal to the amount paid will be issued and may be applied to a future booking.
• Same-day cancellation or no-show: No refund or credit will be issued.
• Weather cancellations: If we determine conditions are unsafe for equipment operation, we will work with you to reschedule at no additional charge or issue a full credit.

4. Delivery, Setup & Pickup

Fun Zone Party Rentals will deliver, set up, and retrieve all rented equipment. The Customer is responsible for ensuring a clear, level, and accessible setup area free of debris, overhead obstructions, and underground utilities. A flat, grassy or concrete surface is required for inflatables.

Delivery windows will be communicated at the time of booking. We are not responsible for delays caused by traffic, weather, or circumstances beyond our control. The Customer must be present at delivery and pickup.

5. Safe Use & Supervision

The Customer assumes full responsibility for the safe use of all rented equipment during the rental period. The Customer agrees to:

• Provide continuous adult supervision of all participants at all times.
• Follow all safety instructions provided by Fun Zone Party Rentals staff at setup.
• Limit occupancy to the maximum capacity posted on each unit.
• Prohibit shoes, sharp objects, food, drinks, and silly string inside inflatables.
• Not allow participants to climb on exterior walls or jump from the unit.
• Immediately cease use and contact us if any equipment malfunction or safety concern arises.

6. Damage & Loss

The Customer is responsible for any damage to rented equipment beyond normal wear and tear, including damage caused by misuse, negligence, unauthorized modifications, or failure to follow safety guidelines. The Customer will be charged the cost of repair or replacement at fair market value.

Equipment must be returned in the same condition as delivered. Fun Zone Party Rentals reserves the right to charge the Customer's payment method on file for any documented damage.

7. Limitation of Liability & Indemnification

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, FUN ZONE PARTY RENTALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THE USE OF RENTED EQUIPMENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC RENTAL GIVING RISE TO THE CLAIM.

The Customer agrees to indemnify, defend, and hold harmless Fun Zone Party Rentals, its owners, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of the Customer's use of rented equipment or breach of these Terms. See also Florida Statute § 616.242 regarding inflatable amusement ride safety requirements.

8. Weather & Force Majeure

Inflatables must not be operated in winds exceeding 15 mph, during lightning, heavy rain, or other unsafe weather conditions. The Customer agrees to deflate and secure equipment immediately if weather conditions deteriorate. Fun Zone Party Rentals is not liable for events cancelled or interrupted due to weather or other circumstances beyond our reasonable control.

9. Electronic Signatures & Consent

By completing a booking and checking the agreement box, you acknowledge that you have read, understood, and agree to these Terms of Service. Your electronic acceptance constitutes a valid and binding signature under the Florida Electronic Signature Act, Florida Statutes § 668.50 (Uniform Electronic Transactions Act), and has the same legal effect as a handwritten signature.

10. Privacy

We collect personal information (name, email, phone number) solely for the purpose of processing your reservation and communicating with you about your booking. We do not sell or share your personal information with third parties except as necessary to process payment or comply with applicable law.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Orange County, Florida, and the parties consent to personal jurisdiction in such courts.

12. Changes to These Terms

Fun Zone Party Rentals reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
